Terms of Use

These Terms of Use are an agreement between you and Unhinged Ventures ("we," "us"), based in British Columbia, Canada, covering your use of the BakeUp app. By creating an account or using BakeUp, you agree to these terms and to our Privacy Policy.

1. What BakeUp is

BakeUp is a baking-education app: structured lessons, quizzes, and tools to practice real bakes and track your progress. It's for personal, non-commercial use.

2. Your account

You need an account to use BakeUp. Keep your credentials to yourself and tell us if you suspect someone else is using your account. You must be at least 13 years old (or the minimum age of digital consent where you live). You can delete your account at any time from inside the app (Profile → Delete account).

3. BakeUp Membership (subscription)

BakeUp requires an auto-renewing subscription, BakeUp Membership:

Free trial

New members get a 14-day free trial. When the trial ends, your subscription begins automatically and your Apple ID is charged, unless you cancel at least 24 hours before the trial ends. Trials are for new subscribers; an Apple ID that has already used an introductory offer for BakeUp isn't eligible for another.

Billing and renewal

All payments are processed by Apple through your App Store account — we never see your payment details. Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the current period ends.

Cancelling

Cancel any time in your device's Settings → your Apple ID → Subscriptions, or in the App Store app. Deleting the BakeUp app does not cancel a subscription. When you cancel, you keep access until the end of the period you've paid for; we don't offer partial-period refunds.

Refunds

Because Apple processes all payments, refund requests are handled by Apple through reportaproblem.apple.com. We can't issue App Store refunds directly.

Price changes

If we change subscription prices, the new price applies to renewals after reasonable notice, and Apple will notify you as their policies require. If you don't agree with a price change, cancel before it takes effect.

4. Your content

Photos you add to BakeUp remain yours. You give us a limited license to store and display them back to you, which is what makes the feature work. Your bake photos are private to your account — we don't publish them or show them to other users. Don't upload content you don't have the right to use, or content that's unlawful.

5. Our content

Everything else in BakeUp — lessons, recipes, quizzes, illustrations, the Betty character, the BakeUp name and wordmark — belongs to Unhinged Ventures or our licensors and is protected by copyright and trademark law. We give you a personal, non-transferable, revocable license to use the app and its content for your own learning. You may not copy, redistribute, resell, scrape, or build derivative products from BakeUp content without our written permission.

6. Acceptable use

Don't misuse the app: no reverse engineering, no attempting to access other users' data, no interfering with the service, no using BakeUp for anything unlawful. We may suspend or terminate accounts that violate these terms.

7. A note about baking

Baking involves hot ovens, sharp tools, and common allergens (flour, eggs, nuts, dairy, and more). BakeUp's content is educational — use your own judgment in the kitchen, supervise children, check ingredients against your own allergies and dietary needs, and follow the safety instructions for your own equipment. You bake at your own risk.

8. Disclaimers

BakeUp is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the app will be uninterrupted, error-free, or that any particular bake will turn out — some of ours haven't either.

9. Limitation of liability

To the maximum extent permitted by law, Unhinged Ventures will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of BakeUp. Our total liability for any claim relating to the app is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you — nothing in these terms limits rights you have under consumer-protection law that can't be waived.

10. Termination

You can stop using BakeUp and delete your account at any time. We may suspend or terminate your access if you materially breach these terms. Sections 4, 5, 8, 9, and 11 survive termination.

11. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Disputes will be resolved in the courts of British Columbia, unless mandatory consumer law where you live provides otherwise.

12. Changes to these terms

We may update these terms as the app evolves. If changes are material, we'll update the date above and tell you in the app. Continued use after changes take effect means you accept them.
